Legal aspects of digital identity and online reputation

Abstract

The article conducts a legal analysis of the process of creating digital identity and managing online reputation of natural persons and legal entities, giving special attention to the web 2.0 tools and the impact of the activity of users in shaping online reputation. On the one hand, the article observes that the increasing legal protection for digital identity of individuals is creating a new Digital Identity Right, that is, to exist on the Internet, and a unified set of rights designed to safeguard the respect of data protection and other rights of personality under the name of Right to Be Forgotten. On the other hand, the article shows that the legal protection accorded to legal persons, under the law in force, in relation to the creation of digital identity and online reputation management, is limited to the objective dimension of the Right to Honor. The article notes and concludes that existing legislation affects all stages of digital identity creation, making it necessary to adopt and develop a special legal sensitivity in both natural and legal persons as well as Internet users, themselves.
