El derecho humano a un medio ambiente sano en el Tratado de la Constitución para Europa

Resumen

La preocupación por el medio ambiente y el desarrollo sostenible ocupa un lugar destacado en la redacción de la Constitución Europea, especialmente si se compara con los anteriores tratados. Sin embargo, este artículo trata de mostrar que no es suficiente. La propuesta consiste en incluir el derecho a un medio ambiente sano como uno de los valores constitutivos de la Unión Europea. Con esa finalidad se justifica la posibilidad y la necesidad de que exista el derecho a un medio ambiente sano como un derecho humano de tercera generación, a través del análisis de los derechos humanos como la concreción de las actuales exigencias universales de la dignidad humana.


Concern for the environment and sustainable development is accorded a significant presence in the draft of the European Constitution, especially when compared to former treaties. However, this paper sets out to demonstrate that it is not sufficient. We propose that the right to a healthy environment be included as one of  the constituent values of the European Union. To this end, we justify the possibility and necessity for the right to a healthy environment as a third generation human right, through the analysis of human rights as the implementation of the current universal demands of human dignity.
